Subject: Beachwood Estates Homeowners Association, Inc.

Dear :

I am writing on behalf of the above referenced community regarding the following matter.

It has come to our attention that you received a complaint from a resident of the community regarding school buses being parked within the community for short periods of time.

It is the consensus of the Board of Directors for the Beachwood Estates Homeowners Association that this matter does not infringe upon the bylaws of the community. The documents restrict commercial vehicles over 3/4 ton to be stored or kept in the community. The majority of the Board feels that the parking of these school buses in the community in between pick ups does not conflict with the bylaws and will allow them to continue to be parked as they have been.

What about enforcement/waiver consistency?

What about the following Declaration Sections?:

  • 2.14 (c) (Vehicles) that says:

Trailers, boats, buses, campers and tractors shall not be parked, stored, maintained or repaired on any Lot except in a garage.

  • 2.1 Architectural Review

The Declarant hereby grants to the Architectural Review Committee, its successors and assigns, the right to establish architectural design criteria for the Community, (the "Design Guidelines") and rules and regulations pertaining to the use of the Lots, which shall be made available to all Members, and to waive such portion or portions of the Covenants numbered 2.3 through 2.26 of this Article II as the ARC, in its sole discretion, may deem advisable and in the best interests of the Community.
